Bitcoin Holding Period: Is the CDU Caving In? - Everything You Need to Know Now!
Current Status of the Crypto Tax Reform
The planned abolition of the one-year holding period for Bitcoin and cryptocurrencies as of January 1, 2027 is hanging in the balance. The German Federal Ministry of Finance (BMF) has published a draft bill, but the decisive cabinet meeting was unexpectedly postponed – partly due to a petition and many letters to members of parliament.
What the Draft Proposes- No more holding period: From 2027, crypto gains would be taxable regardless of how long you hold.
- Tax rate: 25 % (plus solidarity surcharge and possibly church tax) – similar to stocks. The saver's lump sum of €1,000 would apply.
- Staking & Lending: Future staking and lending rewards would be treated as capital income (25 %). Only coins already staked before 2027 enjoy grandfathering.
- Substitute valuation base: If purchase costs cannot be proven, 50 % of the sale proceeds would be taxed – a constitutionally questionable point.
- Tax advisors warn of massive regulatory gaps (e.g., inheritance cases, zero acquisition costs).
- CDU/CSU reject the draft in its current form (systematic inconsistency, excessive substitute valuation).
- Crypto industry (Bitcoin Association, Blockchain Association) fights to keep the holding period.
- Gold would logically have to be treated the same way – increasing opposition.
- International data exchange (DAC8/CfC) starts in 2027 – data will be available anyway, making a rushed reform seem unnecessary.
- Scenario A (25 %): Cabinet passes soon – everything takes effect on Jan 1, 2027.
- Scenario B (45 %): Further delays – the law will be passed later in a softened form (e.g., lower substitute valuation).
- Scenario C (30 %): Union blocks the reform entirely – the holding period remains.
- Stay calm – no law has been passed yet.
- Secure your records (CSV exports from exchanges, transaction histories).
- Separate holdings – document all transfers carefully to preserve grandfathering.
- No panic selling – wait and see how the situation develops.
- Create a tax report – use tools like Cointracking (update at least monthly).
- Build up old holdings before 2027? – from a tax perspective, it might be attractive to buy coins before the deadline to accumulate tax-free old holdings (not investment advice).
